Man charged with murder after car accident

Posted on August 30th, 2011 No Comments

A 32 year-old man was found guilty of second-degree murder after he killed two people while test driving a car. The man was test driving a Dodge Challenger that reached speeds of over a 100 mph when he crashed into another car, killing the driver and her step father.

The car accident occurred in August 2009 in Louisville. His attorneys argued that he did not fully understand the power of the car, but the victims’ family say that he knew exactly what he was doing. The jury sentenced the driver to the minimum sentence and recommended that the two five-year sentences in prison run concurrently. He can be up for parole after serving 20% of his sentence.

Wrongful death lawsuit will test Indiana’s treatment of gay couples

Posted on August 23rd, 2011 No Comments

The wife of a 42 year-old woman who was killed after a stage collapsed during the Indiana State Fair has filed the first wrongful death lawsuit against the state and three construction companies. Six people died and nearly four dozen people were hurt when a gust of wind caused the stage to fall down before Sugarland was suppose to perform.

The 49 year-old widow also suffered serious and permanent injuries from the incident. The lawsuit, which is suing Mid-America Sound Corp., the state of Indiana, Dave Lucas Entertainment Group, and Live Nation for $50 million, claims the stage was built without proper permits, inspection, and did not follow OSHA’s safety procedures. But since gay marriage is illegal in Indiana, the widow, who raised a 17 year-old daughter with her late wife, may not see anything that could come from a settlement since only spouses and next of kin can receive benefits from wrongful death lawsuits.

High percentage of doctors will face malpractice suits

Posted on August 22nd, 2011 No Comments

A study by Harvard University shows that a staggering 99% of physicians in high-risk fields will face medical malpractice lawsuits by the time they are 65 years-old. Doctors in low-risk fields don’t fare much better, about 75% will also face malpractice claims.

Researchers believe that these figures force doctors to practice defensive medicine, which some credit to the rising costs of health care. Some doctors will order extra tests or procedures to protect themselves from a possible lawsuit. The study looked at research conducted between 1991 and 2005 of nearly 41,000 physicians.

Another study that was published in The New England Journal of Medicine showed that about only 1 in 5 malpractice suits resulted in monetary settlements.

Two die in car accident

Posted on August 16th, 2011 No Comments

A single-car accident claims two lives when the vehicle crashed into a tree just outside of Bowling Green. Investigators believe speed was the main contributor of the accident. The driver and passenger were killed when the car was speeding over a sharp turn, causing it to skid off the road and hit a tree. The vehicle immediately burst into flames, says one witness.

The impact of the crash caused the car’s battery to fly out and land in a neighboring front yard. It took nearly three hours for emergency responders to remove the bodies from the mangled car.

Our deepest sympathies are with the family and friends of the two victims who died in this tragic accident.

Posted on August 10th, 2011 No Comments

The Kentucky State Police have donated $40,000 to local filmmaker, Jason Epperson, and his movie titled Impact: After The Crash. Epperson’s movie will profile one of the deadliest drunk driving accidents in history in which a drunk driver hit a bus and killed 27 people and injured 34. Upon impact, the school bus burst into flames.  The accident occurred in Carrollton, Kentucky on May 14, 1988.

The money comes from the 2011 Enforcing Underage Drinking Laws program. So far the film project has raised half of its budget. Epperson plans on interviewing and speaking with the families of the victims and survivors. Epperson has teamed up with Harold Dennis, a survivor, to help share his story.

US government pays $7.5 million in medical malpractice lawsuit

Posted on August 8th, 2011 No Comments

The wife of a retired Air Force master sergeant was awarded $7.5 million by the US government after Air Force medical staff failed to diagnose and treat her for a herniated spinal disk seven years ago.

The woman had gone to the doctors several times for numbness in her groin, legs, and feet. The Guam hospital failed to do a basic medical examination, did not report the case to superiors, and misdiagnosed her condition, which has left her permanently disabled. Although she underwent an emergency surgery in Hawaii, she still suffers from nerve damage due to the lack of treatment.

United States sues Kentucky nursing home

Posted on August 1st, 2011 No Comments

The Villaspring Health Care and Rehabilitation Center in Erlanger is under fire as the United States files a lawsuit against the nursing home, claiming that it billed Medicare and Medicaid $16 million  for “worthless” services. The lawsuit states the nursing home attempted to defraud the United States by forcing the government to pay for services it provided in an abusive and deficient manner.

The US states Villaspring failed to provide adequate care which led to death for some patients. This is not the first complaint the rehabilitation center has received. A complaint was filed in 2007 by the Kent County Attorney General and court papers claim that from 2004 to 2008, the Villaspring Health Care and Rehabilitation Center’s neglect of physician’s orders, patient injuries, and patient’s health requirements caused numerous injuries and, in five cases, death.
