Dollar True faces slip and fall lawsuit

A 55 year-old woman has filed a lawsuit against Dollar Tree Inc. after she slipped and fell on a clear liquid in the store. She claims she suffered injuries to her right hip and knee and her dressed left her exposed, “compromising her modesty.”

The accident happened last December when she was with her grandson. She says no employees helped her and her grandson had to rearrange her dress for her.

The woman is suing the company for $75,000 in damages for pain and suffering, embarrassment, lost wages, medical expenses, emotional trauma, as well as court costs and interest. She argues that the company was negligent for not putting up warning signs, failing to supervise and train employees, and failing to monitor the store for dangerous conditions.

Settlement reached in 2001 anthrax death

The widow of 63 year-old man who was killed after being exposed to anthrax during the 2001 attacks has reached a settlement with the U.S. government in her wrongful death lawsuit.

She filed the lawsuit in 2003, claiming the government was negligent in securing the disease at a military laboratory. In an investigation conducted by the Department of Justice, it concluded that a U.S. Army scientist was behind the deadly anthrax attacks.

Her husband was the first of five to die from the attacks after receiving an anthrax-laced letter at his office where he worked as a tabloid photo editor for the National Enquirer. The details of the settlement were not released, but in the widow was originally demanding $50 million in damages.

Dog attacks teenager and police officer

An American Stafford Terrier mix, not usually known as an aggressive breed, attacked a teenage boy last week and the officer that came to his aid. Police say the boy suffered several lacerations on his arm and legs and lost a lot of blood but is expected to be okay.

The boy was visiting a neighbor who was dog-sitting the animal at the time of the accident. The neighbor and another individual fled the home and ran next door, carrying the injured boy. They say the dog continued to chase them and attacked the boy again.

When police officers came, the dog charged at them. An officer shot and killed the animal.

Long recovery for woman involved in car wreck

A 25 year-old woman has a long road to recovery after she was involved in a fatal car accident this past summer. Her friend was driving near Richmond on Interstate 75 when a driver going the wrong way struck their vehicle head-on. The man in the other car was killed along with her friend.

The woman suffered major trauma as a result of the accident. Her right elbow was shattered, both her legs, kneecap, and ankle suffered compound fractures, and her lungs were bruised. She broke her pelvis, jaw, right arm, two vertebrae in her neck, and suffered a brain injury. She has had over a dozen surgeries and is scheduled for more.

Childhood sleeping habits could result in ADHD misdiagnosis

A new study suggests that children who do not have a fixed bedtime or those who share a bed with a parent or sibling could have adverse effects their behavior. Many of these adverse effects have the strong potential to lead to a misdiagnosis of ADHD.

Compared to children who do have a fixed bed time, children who do not are more likely to throw tantrums, have aggressive behavior towards parents, have low self-confidence, get in trouble at school, and be diagnosed with behavior or learning problems.

While the researchers acknowledge that many of these characteristics are typical of children who suffer from ADHD, they state that these kinds of behaviors are not enough for a diagnosis. They warn, however, that many children have been wrongly diagnosed with ADHD because they display the such actions.

Man burned trying to put out fire

The father of two young children is in the University of Tennessee Medical Center recovering from severe burns after he tried to put out a fire on his trailer’s wooden deck. Late last week, the occupants in the house heard a popping sound outside. The man went outside to investigate, only to find a fire had started right outside his door.

He tried to put out the fire by stomping on it, but ended up burning the top half of his body. His wife and their children, as well as two neighbors and their children, were all able to escape unharmed. Police are currently investigating the cause of the fire.

Jury awards millions in nursing home abuse lawsuit

A West Virginia jury has awarded more than $90 million in punitive and economic damages to the family of an elderly woman who died as a result of nursing home neglect.

The woman, who was suffering from dementia, entered the nursing home able to walk with the aid of a walker and was communicative. While in the nursing home, the staff failed to feed and care for her to the point where she was severely dehydrated and could no longer feed herself three weeks later.

Her son says when he approached the nursing home about getting her properly situated he was given a wall of paperwork and other delays that could have saved her life.

Truck accident caused by cellphone

A tragic trucking accident that left ten people dead last year was found to be caused by the truck driver using his cellphone. Investigators found that his phone call lasted on one second before he became distracted and crossed the median on I-65 near Munfordville. The 45 year-old driver hit a van head-on carrying twelve people. The only survivors were two children strapped in car seats.

Now, the National Transportation Safety Board is urging the Federal Motor Carrier Safety Administration to ban all cellphone use, including texting, for commercial truck drivers except in emergency situations. However, this regulation may have to go before Congress to be approved since it involves interstate commerce.

Honda and Subaru recall defective vehicles

This week Honda and Subaru have issued recalls for thousands of vehicles. Nearly 311,000 2009-2011 Honda Pilots and more than 500,000 Subaru models are affected by the recall, according to the National Highway Traffic Safety Administration.

Honda believes a possible defect in the front seatbelts could potentially result in injury during a crash. The automaker found missing or incomplete stitching on the seatbelts may cause them to disconnect from the anchor webbing, which would not properly protect occupants in an accident.

Subaru is recalling 2010-2011 Outbacks and Legacies for a possibly dangerous malfunction in the vehicles’ wiper motor. The malfunction could cause the motor to become overheated and catch on fire. 2002-2007 Imprezas, 2005-2006 Saab 9-2xes, and 2003-2008 Foresters are also being recalled after reports of the front control arms breaking. At least two drivers lost control of their vehicles after the front control arms corroded and broke.

Plane crash kills Russian hockey team

Only two survivors were pulled out of the Yak-42 plane after it crashed shortly after take off earlier today in Yaroslavl, Russia. The plane was carrying 45 passengers, all members of Russia’s Kontinental Hockey League. The players were on their way to Belarus to play the first game of the new season.

The cause of the crash is still under investigation. The weather was clear and sunny; investigators say the plane was having trouble gaining altitude after take off when it suddenly hit a signal tower and burst into flames. According to reports, one survivor, a Russian hockey player, has suffered burns to nearly 80% of his body. The one other survivor was a plane engineer and he is in serious condition.
