Faulty equipment blamed for infant’s cerebral palsy

Posted on May 8th, 2012 No Comments

A Philadelphia jury awarded a young mother and her three year-old son $78.5 million after the boy developed cerebral palsy due to a delayed cesarean section. An ultrasound initially concluded that the infant had died, but another ultrasound more than an hour later found a fetal heartbeat.

The mother and her lawyer claim that the 81-minute delay in delivery had caused the condition of the already oxygen-deprived fetus to deteriorate, resulting in cerebral palsy. They contend that the ultrasound technician was not properly trained and that the equipment was antiquated.

The $78.5 million will go towards the future medical care of the child, his pain and suffering, the mother’s lost earnings, and her emotional distress.
