Jury verdict calls MasterCraft boat design defective, awards $30 million to victim

A jury in California recently awarded a young woman over $30 million in a lawsuit against MasterCraft, a Tennessee-based boat manufacturing company, after she was severely injured while riding on the X-45 boat with a group of friends.

The accident occurred in 2006 on Lake Oroville. The 27-year-old woman was riding on the boat when water suddenly submerged the bow of the boat. The woman, as well as a friend, were swept off the boat and hit by the its propeller. The woman’s head and face was hit three times by the spinning propeller, and she suffered serious injuries to her brain and face. The woman’s friend suffered injuries to her legs and back.

A former employee of MasterCraft testified during the trial, saying that the boat was never tested on claims that it could safely hold up to 18 people. The jury ruled that the X-45’s design was defective because of its large bow that easily becomes submerged in water, and the company has been asked to issue a recall of the boat.

Chicken products recalled by Kentucky company for unlabeled allergen

The Louisville company, Stir the Pot, LLC, recently issued a recall of several of its chicken products after FDA inspectors discovered that a sauce in the chicken contained anchovies, which was not on the product’s label. Over 18,000 pounds of chicken products were recalled.

The unlabeled anchovies, which are known allergens, were found on May 5. The chicken products had already been distributed to food service companies in Kentucky, Indiana, Georgia, Tennessee, and Ohio, however, the recall was issued before the chicken hit store shelves. No reports of illness caused by the chicken products have been issued.

Anyone with an anchovy allergy who has consumed the chicken has been advised to contact an emergency center or hospital.

Lawsuit filed against Four Loko by parents of dead teen

A wrongful death lawsuit was recently filed against the manufacturers of Four Loko by the parents of a 15-year-old boy who died after he became extremely intoxicated from drinking two cans of the beverage.

On September 25, the under-age Virginia boy purchased Four Loko at a Manassas gas station. He then went to a Sugarland concert, where he was thrown out for inappropriate behavior. After the boy’s mother came to pick him up, he ran from her vehicle and into a dark highway, where he was hit by an SUV. He died in the early morning of September 26.

This is the second lawsuit to be filed against the manufacturers of Four Loko, which is nicknamed “blackout in a can” for its high alcohol content. The parents of the young boy also filed a lawsuit against the gas station from which he purchased the alcoholic beverage.

One dead, two injured during Louisville car crash

A car accident occurred in Louisville on Thursday that left one person dead and two people injured. The accident happened at approximately 9 a.m. at the intersection of Greenbelt Highway and Trade Port Drive.

According to reports, a 54-year-old woman driving a Taurus was attempting to turn left at the intersection when a man driving a Chevy Cobalt hit the Taurus. The woman was taken to the hospital, where she died of her injuries. The man driving the Chevy Cobalt and a male passenger were both injured in the crash and were also taken to the hospital.

A police officer was able to witness the accident, and other officers are speaking with him to find out the cause of the accident.

Two Kentucky men survive Haverhill plane crash

Two men from Kentucky escaped serious injury during a plane crash that occurred in Haverville on Saturday night.

According to reports, a 56-year-old man and his 45-year-old instructor were flying a Cessna 172 F. Almost immediately after leaving the Ashland/Boyd County Regional Airport, the electrical power in the plane’s cockpit malfunctioned. The men aboard the plane reported that they heard sputtering sounds coming from the cockpit before the plane completely lost power and crashed in an open field.

The men sustained minor injuries and were treated by a local EMS. The Federal Aviation Administration is still investigating the crash.

Court rules that patient cannot file lawsuit for surgical error 2 years after surgery

An Idaho court recently ruled that a man who had wrong site-surgery performed in 2004 was not able to file a malpractice lawsuit against the doctor who performed the surgery because the mistake was not found until two years after the surgery.

The man underwent spine surgery in 2004 after he suffered a work-related injury. The doctor installed a plate into the T6-7 area of the man’s spine, instead of the T6-5 area of the spine which is where he intended to perform the surgery. Neither the man nor the doctor were aware of the mistake until two years later when the man suffered another spinal injury. Upon the doctor’s examination, he realized that he had performed surgery on the wrong part of the spine and that was the cause of the man’s pain.

The doctor informed the man of his mistake, however, a court in Idaho, as well as the Supreme Court, denied the man’s request to file a lawsuit against the doctor because the statute of limitations for the malpractice had run out.

One injured in 3-vehicle crash with semi-truck

A 3-vehicle crash occurred in Florence on Tuesday at 3 p.m. that left one driver injured. The accident involved a car, a truck with a trailer, and a semi-truck.

The accident happened on US 42. According to police reports, the car struck the trailer-towing truck from behind. Immediately after hitting the truck, the car was rear-ended by a semi-truck. The accident caused two lanes of the highway to be closed for several hours as police cleaned up the scene.

The driver of the car was injured and taken to University Hospital by helicopter. The driver’s current condition has not been reported. Police investigations into the accident are still underway.

Man injures knee while dining at Texas restaurant, files lawsuit

A lawsuit was recently filed against a Chuy’s restaurant in Texas by a man who seriously injured his knee while walking up the restaurant’s entry ramp.

The ramp on which the man fell had recently been painted. The lawsuit filed against the restaurant claims that the fresh paint was too slippery and caused the man to fall. It further states that the restaurant did not have signs posted to warn customers of the wet paint and its possible dangers.

Parkway Construction, the company that had painted the ramp, was also cited in the lawsuit for causing the man to fall. The man is seeking punitive and compensatory damages.

Man charged with setting fire that killed two

A 32-year-old man from Indianapolis was recently charged with setting a fire on May 10 that killed two people.

According to reports, the man lived with his girlfriend and her family in Illinois. Just days before the fire, the man had complained about the landlord of the house in which they were living because he was attempting to evict them. Officials have said that they believe retaliation against the landlord was the man’s motive for starting the fire.

The 63-year-old mother of the man’s girlfriend and her 47-year-old brother died in the fire. The man was charged with two counts of murder, as well as arson to a dwelling. He is currently being held in jail without bail.

Kentucky teacher recovering in rehab following brain injury

A Kentucky teacher and state representative who suffered a brain injury after breaking up a fight between students last month is making progress in a rehabilitation center.

The 49-year-old man was a teacher at Whitley County High School for 17 years. On April 12, a fight broke out between two students, and the man ran to stop it. While doing so, he was punched in the head, which caused him to fall to the ground and hit his head on the tile floor. He suffered a traumatic brain injury in the incident.

The two students involved in the fight are now serving time at a juvenile detention center. The man, who has been staying in the rehabilitation unit of the Kentucky Medical Center, is making progress in his recovery, although doctors have not said what the man’s exact condition at this point is.
