A wrongful death case against Kindred Hospital-Louisville which was co-counseled by attorney Jeffrey T. Sampson of the Sampson Law Firm has resulted in an award of more than $463,000 for the widow of a man whose death was caused by the negligent policies of the hospital and its parent companies.
James White was receiving treatment at Kindred Hospital-Louisville in 2011, during which time his physical condition was in such a weakened state that he required assistance to even move from his bed. A single nurse was tasked with helping to move him from his bed to the bedside commode and back on her own. Unfortunately, she was unable to fully support his weight, dropping Mr. White on the bed and dislodging his breathing tube, which ultimately led to his death.
The arbitrator in the case found that the staffing and patient care policies of Kindred’s different companies were the direct cause of Mr. White’s death, and awarded his widow $463,570.60 in damages.
